Since the Illinois Tort Immunity Act doesn't cover anyone for the wanton and intentional acts that they committed...

Under the Illinois Tort Immunity Act, "willful and wanton conduct" is defined as an intentional course of action intended to cause harm, or a conscious disregard for the safety of others or their property. It can also be characterized as reckless or wanton negligence.

The Attorney Registration and Disciplinary Commission (ARDC) is overseen by the Illinois Supreme Court and a seven-member Commission: 

  • Illinois Supreme Court
    The Supreme Court has the sole authority to regulate the admission and discipline of lawyers in Illinois. The Supreme Court delegates administrative responsibility for this to the ARDC. 


  • Commission
    The Commission is a board of directors for the ARDC that sets general policy and oversees its implementation. The Commission is made up of seven members, four of whom are Illinois bar members and three of whom are non-lawyer "public members". The Supreme Court appoints the Commission members to serve three-year terms, with a maximum of three terms. 

  • Administrator
    The Administrator is the principal executive officer of the ARDC. The Administrator is appointed by the Commission with the approval of the Supreme Court. Lea S. Gutierrez began her service as the ARDC's Administrator on October 23, 2023. 

    The ARDC's mission is to protect the public and the integrity of the legal profession. The ARDC's responsibilities include: Lawyer registration, Education, Investigation, Prosecution, and Remedial action.
